Terms of Service

By accessing and using our auction platform, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Permission is granted to temporarily access our platform for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• modify or copy the materials
• use the materials for any commercial purpose or for any public display
• attempt to reverse engineer any software contained on our platform
• remove any copyright or other proprietary notations from the materials

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time.

Account Registration

To participate in auctions, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

Account Responsibilities

• You must be at least 18 years old to create an account
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You may not transfer your account to another person

Bidding

• All bids are binding and cannot be retracted except in exceptional circumstances
• You must have a valid payment method on file to place bids
• You may be required to complete identity verification before bidding
• Bids must meet the minimum increment requirements
• The highest bidder when the auction ends wins the item

By placing a bid or completing a purchase, you agree to our Refunds and Dispute Resolution Policy, which explains dispute eligibility, return requirements, and how refunds are processed.

Nothing in these Terms limits statutory consumer rights that apply when buying from a commercial seller. Auction sales generally do not include a cooling-off cancellation right, but goods must still be as described and of satisfactory quality where applicable.

Selling

• You must own the items you list or have authorization to sell them
• Item descriptions must be accurate and complete
• You must ship items promptly after receiving payment
• You are responsible for any applicable taxes on your sales
• You must comply with all applicable laws and regulations, including tax and export rules
• You may be required to complete identity verification and payment processor onboarding (including KYC)

If a material misdescription is discovered after the standard dispute window, we may still review the matter and take action in line with our Refunds and Dispute Resolution Policy.

Pickup (Collection)

• Sellers may offer pickup as a fulfillment option on eligible listings.
• Sellers must provide a pickup address and at least one contact method for buyers.
• Buyers selecting pickup must arrange collection directly with the seller and confirm pickup after collection.
• Pickup must be confirmed within 15 days of payment unless a dispute is open.
• If pickup is not confirmed within the window, the transaction may complete automatically.

Prohibited Items

Certain items are prohibited from being listed on our platform, including but not limited to illegal items, stolen goods, counterfeit goods, weapons, hazardous materials, and items that infringe on intellectual property rights. You are responsible for ensuring your listings comply with all applicable laws and regulations. For detailed definitions and examples, please see our Prohibited Items Policy.

Buyer Fees

Buyers pay a platform fee in addition to the winning bid. The current buyer fee is 5% of the winning bid, but this percentage may change. For example, a winning bid of 100 means the buyer pays 105 in total.

Seller Fees

• Listing items is free
• We charge a platform fee on successful sales
• The current seller fee is 5% of the winning bid, but this percentage may change
• Fees are automatically deducted from your sale proceeds
• In the example above, the seller receives 95 after a 100 winning bid

Platform fees are generally non-refundable. If a refund is approved due to non-delivery (for example, the seller failed to ship or the item was not received) or the seller account is deleted, platform fees are returned, but payment processing fees are still deducted from the refund amount. For other approved refunds, platform fees are not returned.

Payment Processing

All payments are processed through secure third-party payment processors. We do not store your full payment details on our servers, but we may store references to your payment method via our processor to enable off-session charges. Payment processing fees charged by third-party payment providers are non-refundable and will be deducted from any approved refund. This reflects costs already incurred in processing the original transaction.

Non-refundable payment processing fees

Payment processing fees charged by third-party payment providers (for example, Stripe fees) are non-refundable and are deducted from any approved refund. This applies to all refund routes and dispute outcomes.

Account Deletion and Auto-Charging

If you request account deletion, your account will enter a pending deletion period. Your account will be deleted after 14 days, or sooner once all outstanding obligations are cleared. During this time, if you have won auctions or unpaid invoices, we may automatically attempt to charge your default payment method to fulfill your legal obligations. Sellers may be provided your default shipping address so they can ship items without separate address confirmation.

The platform and its original content, features, and functionality are and will remain the exclusive property of our company and its licensors. The platform is protected by copyright, trademark, and other laws.

You retain ownership of any content you submit to our platform, but you grant us a license to use, display, and distribute that content in connection with our services.

You agree not to:

• Use the platform for any unlawful purpose or to solicit others to perform unlawful acts
• Violate any international, federal, provincial, or local regulations or laws
• List or purchase illegal, stolen, counterfeit, or restricted items
• Evade taxes, sanctions, or other legal obligations related to transactions
• Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• Submit false or misleading information
• Upload viruses or any other type of malicious code
• Spam, phish, pharm, pretext, spider, crawl, or scrape
• Interfere with or circumvent the security features of the platform

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the platform, to understand our practices regarding the collection and use of your personal information.

The information on this platform is provided on an 'as is' basis. To the fullest extent permitted by law, this Company:

• excludes all representations and warranties relating to this platform and its contents
• excludes all liability for damages arising out of or in connection with your use of this platform
• does not guarantee the accuracy, completeness, or timeliness of information
• does not warrant that the platform will be available or error-free

In no event shall our company, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, punitive, special, or consequential damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the platform.

We may terminate or suspend your account and bar access to the platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, navigate to the Privacy section of your account settings and use theDelete Account option.

These Terms shall be interpreted and governed by the laws of the jurisdiction in which our company is incorporated, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
